2004 DIGITAL ENTERTAINMENT CONFERENCE & AWARDS RULES
ELIGIBILITY
The 2004 awards are open to any individual, company, business, innovation
or project that has launched, been redeveloped or shown substantial
measurable progress during the awards period, which runs from September
15, 2003 until September 30, 2004.
Entries must fall into one of the 30 awards categories. Entries may be
submitted in multiple categories, if applicable. Entries may not be
submitted more than once per category. There is no limit to the number of
entries that may be submitted by any entrant, however, a complete entry
form and separate entry fee must be submitted with each entry.
Sponsors of the 2004 Awards may submit entries, however, a category
sponsor may not submit an entry in a category, which it is sponsoring.
The company or employer of a juror may submit entries, however, the juror
must recuse himself from judging particular categories where his or her
company or employer has entered submissions.
Sponsors and companies or employers of jurors will receive no special
treatment as ensured by the judging rules. The Awards Co-Chairs in their
sole discretion reserve the right to disqualify any entry or juror at any
point in the judging process on the basis of the appearance of
impropriety.
INELIGIBLE ENTRIES
Submissions that contain pornographic material, make defamatory
statements, promote "hate" messages or are otherwise offensive in the sole
discretion of the Awards Co-Chairs are not eligible for entry. Ineligible
entries may be disqualified at any point without notification.
DEADLINES
The final deadline for entries for the 2004 Awards is September 30, 2004.
All entry forms and full payment of entry fees must be received by this
date to be eligible for entry.

Any award entries or entry fees received after the closing date will be
returned.
ENTRY FEES
$150.00 per entry.
Entry fees are non-refundable once entries have been received.
Eligible non-profits qualify for a reduced entry fee of $75.00 per entry.
An eligible non-profit is a U.S. non-profit organization with a valid
501(c)(3) Tax ID number, or a non-profit organization from outside the US
that can provide equivalent documentation.
PAYMENT INFORMATION
Payment may be made by check or money order made out to "Digital Media
Wire, Inc." and must be in U.S. dollars only.
ENTRY FORM
Each entry must include 5 copies of the completed entry form. The 2004
Entry Form is available online at www.digitalentertainmentawards.com.
Supporting materials specified as optional on the entry form must be in a
reproducible, 8-1/2" x 11" size. Optional supporting materials may also
include actual product samples. Instructions for submitting supporting
materials required for specific categories are stated on the entry form.
We reserve the right to disqualify any submission that does not meet these
entry requirements. An entry may be withdrawn for any reason up until
5.30pm on September 30, 2004 upon written request to the Awards
Administrator. However, entry fees, once received, are non-refundable.
Entrants will receive an email acknowledgement when an entry has been
received. Only nominated entries will be notified beyond that point.
AWARDS CO-CHAIRS
The 2004 Awards Co-Chairs are John Kilcullen, President, VNU Music &
Literary Group and Publisher, Billboard and Ned Sherman, Co-Founder and
CEO, Digital Media Wire, Inc.
SELECTION OF CATEGORIES
The categories are determined at the sole discretion of the Awards
Co-Chairs. The inclusion of a category one year does not necessarily
dictate that it will be included in future years.
SELECTION OF JURORS
Jurors for the Awards are determined at the sole discretion of the Awards
Co-Chairs. Jurors are generally senior executives of leading entertainment
companies, academics and editors, publishers and writers of major North
American media outlets. There are 5 to 7 jurors in each jury for the 2004
Awards. Jurors and juries are determined on a year-by-year basis.
JUDGING PROCESS
Entries will be judged on the basis of the information provided by
entrants on the completed entry form and the supporting materials.
All eligible entries will be reviewed, and a short list of entries will be
nominated for consideration of the jurors for each category. The Awards
Co-Chairs and jurors may draw upon their own experiences to nominate
entries to be included in the short list. The jurors will then select 4
finalists and a winner in each category. In the event of a tie, the Awards
Co-Chairs will determine the winner in a particular category.
Throughout the review and judging process, entries will be evaluated based
on specific criteria relevant to each category as set out in the category
descriptions. Particular focus will be given to:
Innovation - impact on the industry
Creativity - technical and commercial
Content - compelling and unique
Interactivity - user interface and user experience
Business benefits and market success
The jury process is a silent vote process that is designed to minimize
personal, non-objective beliefs from undue influence on other jurors. This
is done to allow each juror to make their judgments based upon personal
experience and not upon the experience of others.
Details of the jury meetings will not be disclosed. The jury decisions are
final and no correspondence will be entered into regarding them.
THE AWARDS BANQUET
Winners will be announced at the 2004 Awards Banquet at the Grand Horizon
Ballroom - Covel at Sunset Village, UCLA
in Los Angeles on the evening of
November 5, 2004.
TERMS & CONDITIONS OF ENTRY
Each entrant represents, warrants and agrees that it owns the rights to
all materials supplied in connection with an awards entry and such
materials do not and will not defame, infringe or violate the trademark,
copyright, patent or privacy rights or any other rights or any third party
and are not the subject of any actual or threatened litigation or claim.
Entrant shall indemnify VNU Business Media and Digital Media Wire, Inc.
and their affiliated entities, assigns and licensees against any loss,
cost or damage (including reasonable attorneys' fees) arising out of or in
connection with any breach of any of the aforesaid representations,
warranties or agreements.
By entering the Awards, each entrant expressly authorizes VNU Business
Media and Digital Media Wire, Inc. to use the specific text and visual
materials submitted for the purposes of promoting the Awards in
presentations, reports for publication, website and media activities as
well as other forms of promotions/publicity materials in all media now
known or hereafter developed.
Submission of an entry that meets all eligibility requirements and full
payment of the entry fee by the deadline as stated herein ensures that the
entry will be reviewed and considered for nomination. No other
representation or warranty is made concerning entries and all implied
warranties are hereby expressly disclaimed.
If for any reason the Awards are not capable of running as planned due to
acts beyond the control of VNU Business Media and Digital Media Wire, Inc,
including acts of force majeure, acts of war, domestic terrorism, fraud,
technical failures, or any other causes beyond the control of VNU Business
Media and Digital Media Wire, Inc., which corrupt or affect the
administration, security, fairness, integrity, or proper conduct of the
Awards, VNU Business Media and Digital Media Wire, Inc. reserve the right
at their sole discretion, to terminate or cancel the Awards without any
liability except the return of entry fees paid.
The Awards shall be governed by the laws of the state of New York without
regard to its conflicts of laws principles and any action shall take place
in the courts of the state of New York.
If an entry is nominated for an award or receives an award, the manner and
details of announcing such nomination and award is strictly within the
discretion of Awards. Entrant understands and acknowledges that all awards
may not be given or publicized in the same manner, and some may be
presented at the 2004 Awards Banquet while others may not.
